Is it mandatory to authenticate the lease agreement with a notary or to register it somewhere?

In most cases, a private-signature lease agreement is sufficient, as long as it is signed by both parties and contains the essential elements: description of the asset, rent, duration, rights and obligations.

However, when a company leases an office, commercial space or any other subdivision, the agreement must mandatorily be registered with the tax authority within 60 days from the signing date. In practice, this procedure is usually handled by the company’s accountant.

For special situations (e.g. very long duration, real guarantees, mortgages or complex clauses), notarial authentication or additional registration can provide a higher degree of legal safety.

Can I later modify the generated agreement (e.g. rent or duration)?

It is important that the changes are recorded in writing, dated and signed, so that both the lessor and the lessee are equally protected.
